Remote working is facilitated in order to implement the planned measures of contention and to guarantee the continuity of the business activity and labour relations after the exceptional situation. Therefore, compliance with PRL obligations is facilitated.
Teleworking during COVID-19
The preferential nature of distance working is declared in order to implement the planned containment measures and to guarantee the continuity of the business activity and labour relations after the exceptional situation.
To this end, companies are obliged to:
- Establish organisational systems that allow the activity to be maintained by alternative mechanisms, particularly by means of distance (remote) working;
- Take appropriate measures, giving priority to temporary cessation or reduction of activity, if this is technically and reasonably possible and if the necessary adaptation effort is proportionate.
In those sectors, companies or jobs in which this type of work was not previously envisaged, the obligation to assess occupational risks and plan preventive activity is understood to be fulfilled through a self-assessment carried out voluntarily by the worker him/herself (RDL X/2020 art.5).
To this end, a programme has been set up to finance the corresponding material by activating aid and credits for SMEs within the ACELERA PYME programme of the public company RED.ES (RDL X/2020 disp.adic.10).
